Adoption and the Care of Orphan Children Essay A common conception is that Islamic law forbids adoptions. However, this belief misses the complexity of Islamic law, the scope of adoption laws and practices across the world, and the overwhelming emphasis on taking care of orphans and foundlings found within Islamic sources. Contemporary adoption practices are immensely complex issues, overlapping with children’s rights, international and national laws, human psychology, economic, social, and religious concerns, and the ethics of lineage, identity, property and inheritance rights. In this position paper, the Muslim Women’s Shura Council considers whether adoption can be possible within an Islamic framework. After examining Islamic texts and history alongside social science research and the international consensus on children’s rights, the Council finds that adoption can be acceptable under Islamic law and its principle objectives, as long as important ethical guidelines are followed. This statement consults the Quran, the example of the Prophet Muhammad (sunna), the objectives and principles of Islamic law (maqasid al-sharia), Islamic Jurisprudence (fiqh), and social science data. The Shura Council finds that, instead of banning adoption, Islamic sources have brought various ethical restrictions to the process, condemning dissimulation and foregrounding compassion, transparency, and justice. These restrictions closely resemble what is known today as the practice of open adoption. Therefore, when all efforts to place orphaned children with their extended family have been exhausted, open, legal, ethical adoptions can be a preferable Islamically-grounded alternative to institutional care and other unstable arrangements. According to Islamic and universal standards of children’s rights, all children have the right to grow up in a nurturing, loving environment where their physiological, psychological, and intellectual needs are met. All children have the right to know their lineage and to celebrate their unique national, cultural, linguistic, and spiritual identity. All children have the right to a safe, supportive environment where their rights to dignity, education, and the development of their talents are well respected. The best interests of the child should be the primary consideration in all decisions relating to children, including adoption. Orphan: Different states and international institutions have different criteria for determining whether a child is an orphan. UNICEF classifies any child that has lost one parent as an orphan and estimates that approximately 143 million children are currently orphans.1 For the purposes of this document, an orphan is a minor who is bereft of parental care due to death, disappearance, or abandonment by either the mother or the father, as well as situations where the parent voluntarily or involuntarily terminates the parental relationship. This definition combines several concepts in classical Arabic, including yatim (fatherless child) and laqit (foundling). Adoption: Adoption can be defined as the legal creation of a parent-child relationship, with all the responsibilities and privileges thereof, between a child and adults who are not his or her biological parents. Adoptions incorporate a child into a family as offspring and sibling, regardless of genetic ties. There are two main categories of adoption practices, generally termed as closed adoptions and open adoptions. However, in reality most adoption practices fall somewhere on a continuum between fully open and fully closed. In â€Å"closed† or â€Å"confidential† adoptions, the birth family and the adoptive family have no identifying information about each other. Children may not be informed that they have been adopted, and they may have no way of tracing biological kin. If the child comes from a different cultural background than his or her adoptive parents, their heritage might be marginalized or ignored. Closed adoptions, therefore, have the potential to dissolve all ties between an adoptee and her biological family. â€Å"Open† adoptions, which are becoming increasingly common across the world, allow for a full disclosure of identities on both sides. Open adoptions facilitate direct interaction between the adoptive family, the adopted child, and any birth relatives. The child’s birth culture may more easily be respected and promoted by the adoptive family and incorporated into the family’s daily life. However, the categories of closed and open are better understood as idealized types, as most families experience a hybrid form of adoption that comprises elements of both open and closed adoption practices. The empirical data on the risks and benefits of each type of adoption has shown mixed results, with some adopted children embracing the opportunity to contact their birth families and others experiencing confusion and insecurity.2 Generally, however, open adoptions are associated with better psychological and behavioral outcomes for the child. With the exception of Indonesia, Malaysia, Somalia, Tunisia, and Turkey, the laws of most Muslimmajority states do not currently permit legal adoption. Instead, laws permit a system of guardianship (kafala), which resembles foster-parenting, but is more stable. Kafala is defined as â€Å"the commitment to voluntarily take care of the maintenance, of the education and of the protection of a minor, in the same way a *parent would do for a child+.†5 According to Jamila Bargach, kafala is seen as â€Å"primarily a gift of care and not a substitute for lineal descent.† In other words, kafala involves the obligations of guardianship and maintenance without the creation of legal ties, which would produce specific personal status legal entitlements. This type of guardianship does not sever the biological family bonds of the child or alter the descent lines for the adopting family. Unlike foster-parenting, kafala is intended to be a permanent arrangement for a minor. Like fosterparenting and adoption, kafala is mediated by the state, in contrast to informal or â€Å"customary† adoptions which take place within families or through secret agreements. Convergences between Kafala and Adoption Whereas this statement focuses on adoption and not kafala, in some cases kafala may lead to adoption. Countries with strict application of â€Å"non-international kafala,† like Iran, Mauritania, and Egypt, reject any legal recognition between kafala and adoption. Citizens of these countries who reside in other countries, where adoption is the law of the land, cannot gain guardianship of a child with the intention of adopting that child in their state of residency. Other states, like Morocco, Algeria, Jordan and Pakistan, allow for placements of kafala children abroad, particularly with nationals living in foreign countries, with certain stipulations. Tunisia and Indonesia allow for a full convergence of kafala and adoption, limiting adoptions to national applicants, whether living in the country or abroad. Islamic Law: The term â€Å"Islamic law† refers to two related, yet distinct concepts, which are often conflated: Sharia and Fiqh. Sharia literally means â€Å"the way† and is a transcendental ideal that embodies the justice and compassion inherent in the totality of God’s will. Fiqh, which literally means â€Å"understanding,† is Islamic jurisprudence and juristic law, which has developed from the eighth century onwards as a human effort to interpret the Sharia. Fiqh has been developed by Muslim legal scholars through analysis of the Quran and the example (sunna) of the Prophet Muhammad, with the aim of securing justice according to the context of each society, time (zaman), and place (makan).7 Adoption in pre-Islamic Arabia During the pre-Islamic period in Arabia, adoption (al-tabanni) into a tribe often took place for socioeconomic and patriarchal reasons. Al-tabanni is derived from the Arabic word ibn, meaning â€Å"son.† In keeping with the patriarchal norms of the era, adoptees were usually, if not always, male.11 People adopted mainly to secure an heir and/or additional warriors for the tribe. Adoption could take place at any time in a persons life, from childhood to adulthood, even if the adoptee’s biological parents were alive.12 The adoptee automatically earned full rights and the responsibilities of a biological child and was given the adoptive father’s name. Since male children were considered a source of wealth and prestige, this benefited the adoptive father.13 Often adoption was undertaken in self-interest with the intention of usurping an orphan’s property, as the adoptive parents would end up managing an orphaned child’s property. In addition, adoption was closely linked to enslavement; captors held the power to strip captives of their birth identities and appropriate them into their families.14 For these reasons, pre-Islamic adoption entailed a complete â€Å"erasure of natal identity.

When most of us here the word leader we think of a superior being. A person that is totally unlike any other. There have been many leaders in the past centuries. One that I found most significant was Louis Armstrong. He was a great musician in so many ways. He patented his own style of music that became known and loved all over the world.   Ã‚  Ã‚  Ã‚  Ã‚  Louis Armstrong was born on August 4th 1901 in New Orleans, Louisiana to Mayanne and William Armstrong. Louis had many great accomplishments throughout his life. While doing what he loved he became a leader everyone loved and recognized. Louis had a hard and painful childhood. His father abandoned the family when Louis was just a little baby. Over the next five years Louis lived with his grandmother, Josephine Armstrong. At just the age of six Louis and three other boys form a vocal quartet and they would perform on the street corners for tips.   Ã‚  Ã‚  Ã‚  Ã‚  In 1922 at the age of 21 Louis moves to Chicago to play second cornet in the band of Joe Oliver. As Louis performs he is slowly being recognized for his music. Finally on April 5 1923 he recorded his first song at the Gennett Studios in Richmond, Indiana as a member of King Oliver’s Creole Jazz Band. In February of 1924 he marries Lil Hardin. She played the piano for the King Oliver’s Creole Jazz Band. In September 1924 he leaves King Oliver and moves to New York City to join the Fletcher Henderson Orchestra. He records a few songs with them.   Ã‚  Ã‚  Ã‚  Ã‚  Finally on November 12th 1925 Louis makes his first recordings as a leader with his own group named the Hot Five. It is here were he created his own style of music called the Satchmo way. This musical style became very popular among the world’s population. On June 28 1928 he records one of the most famous jazz songs ever recorded called â€Å"West End Blue†.   Ã‚  Ã‚  Ã‚  Ã‚  In 1947 he performs in Carnegie Hall with a small group and his big band. In 1948 he appears in the first International jazz festival. In 1954 he publishes his second auto biography called the Satchmo: My Life in New Orleans. In this biography he covers his life until 1922. One of his songs called â€Å"Hello Dolly† becomes number one hit. On July 6 1971 Louis passes away in his sleep at his home in Corona.

Henry V Assignment Essay

Henry V is an impressive piece of literature, which can be read in its entirety to oneself. However, if the full dramatic effectiveness is to be appreciated, it must be seen in its true context as a performance on stage. At the time Henry V was written, theatre played an important part in people’s lives. It was a way of life, and people of all social levels went to see plays by their favourite playwright. Theatres in Elizabethan times took on a conventional style. They are described the Chorus in Henry V as a ‘wooden O’ as they were indeed wooden and ring shaped. At a performance in an Elizabethan theatre the place where you stood depended on your social level. Lower-class people or ‘groundlings’ as they would be called, stood on the ground, surrounding the stage. Here you would not only find people standing to watch the performance, but you would also find family pets and entertainers like Jugglers and Fire Eaters and the richer patrons of the theatre sat in the outer ring. In Henry V there are many scenes, which cannot be acted out on stage effectively. These are mainly the battle scenes, which would involve large armies of men in real life. Shakespeare managed to overcome this problem and keep his audience entertained. The chorus is the first person in the play to speak. He asks the audience â€Å"On your imaginary forces work.† He makes excuses that the stage they are acting on cannot be the same as the battlefields that these events actually took place on â€Å"Can this cock-pit hold the vasty fields of France?† The effectiveness of the play depended on the audience using their imagination to â€Å"into a thousand parts divide one man.† Henry is â€Å"The Mirror of all Christian Kings,† how does Shakespeare build up his character to suggest this and why? Throughout the play, Henry V, Shakespeare gradually builds up a character who is almost perfect in every way. Not only a Christian but a good king. One that future kings should try to mirror themselves on. In this essay, I am going to talk about, first of all how other people in the play help to build up this character and then how Henry’s own actions and words help us to create this image of a perfect king. I will then summarise on the character created and then I will make a conclusion as to whether Henry was actually a good king and whether being a good king makes him a good person. Two of the first people we meet in the play are the Bishops, Canterbury and Ely. They give us the first pieces of information that we need, and that Shakespeare uses, to build up Henry’s character. In Shakespeare’s time, the audience will no doubt have seen Henry IV where Henry is portrayed as drunken and rowdy. Therefore Shakespeare immediately lets the audience of Henry V know that he has changed and is no longer like this. â€Å"The king is full of grace and fair regard.† Canterbury, Act 1, Scene 1, Line 24. â€Å"And a true lover of the holy church.† Ely, Act 1, Scene 1, Line 26. The second of these lines show us that the king is now a Christian who visits church and likes it. Canterbury and Ely plan to use Henry’s Christian conviction to make him drop the tax on the church. So this is our first piece of evidence that Henry is a Christian king. There is a comic subplot that runs throughout the play to detract from the seriousness of the story. If this was not placed in the play, the whole story would seem slightly boring, but there is another reason why this is here. They all give us good pictures of the king and how he has changed. The characters involved in this subplot are, Pistol, Nim, Bardolph and Hostess. Their respect for the king is great, although they feel that their friend John Folstaff died from a broken heart because he lost the friendship of Henry as he became king. â€Å"The King has killed his heart.† Hostess, Act 2, Scene 1, Line 84. It is this loyalty and respect for the king that lets us know that he must be a good king and a good person. He has been a loyal friend but has slipped away as his royal duties have taken over. This does not mean that he is not a good person anymore, or a good king. Although you wouldn’t have thought so, Henry’s enemies, the French, also tell us a lot about him. They know that his power is great and that he is respected in his country. Because they are aware of this power, they feel cautious to feel too confident of victory at Agincourt. They talk amongst one another saying that they think the king is senseless. â€Å"What a wretched and peevish fellow is this King of England.† Orlà ¯Ã‚ ¿Ã‚ ½ans, Act 3, Scene 7, Lines 127-128 We can take this into consideration but it didn’t affect my judgement as they are the enemy and so are bound to say things like that. So therefore we did not learn whether Henry is a good Christian king from the French but we did learn that he is powerful and not so weak as to be rejected as an easy victory. There is another instance where the two countries meet. The Dauphin meets with him earlier in the play and then reports back to King Charles. He tells the king HENRY IS â€Å"THE MIRROR OF ALL CHRISTIAN KINGS,† HOW DOES SHAKESPEARE BUILD UP HIS CHARACTER TO SUGGEST THIS AND WHY? that England is ruled by a â€Å"vain, giddy, shallow, humorous youth.† and that because of this, they have no fear of going to war. King Charles then tells his princes and knights to beware of Henry, because he doesn’t want France to live its past history again. â€Å"And he is bred out of that bloody strain that haunted us in our familiar paths. Witness our too-much memorable shame when Crà ¯Ã‚ ¿Ã‚ ½cy battle fatally struck,† King Charles, Act 2, Scene 4, Lines 51-54. The person who I felt told us the most about Henry’s character was Henry himself. One of the first serious actions we see him take is against the three traitors, Richard, Earl of Cambridge, Henry, Lord Scrope of Masham and Thomas Grey, Knight of Northumberland. Their plan was to kill Henry at Southampton before he departed for France. Henry caught wind of this but didn’t straight away order them to be executed for high treason. We see Henry tell the three traitors that a man had been arrested for shouting abuse at him whilst drunk, he then asks them what they think the punishment should be. â€Å"That’s mercy but too much security.† Scrope, Act 2, Scene 2, Line 44. Scrope tells Henry that he should be punished and used as an example. Henry replies, â€Å"O let us yet be merciful.† Act 2, Scene 2, Line 47. Cambridge thinks that Henry should spare his life but punish him never the less. â€Å"So may your highness, and yet punish too.† Cambridge, Act 2, Scene2, Line 48. Thomas Grey thinks that he should be executed. â€Å"Sir, you show great mercy if you give him life, after the taste of much correction.† Grey, Act 2, Scene 2, Lines 49-50. After all this, we still do not see Henry approach the traitors with what they are planning to do. Instead he hands them each a piece of paper, which reveals what he has learned. He then says, almost sarcastically, â€Å"Why, how now, gentlemen? What see you in those papers, that you lose so much complexion? – Look ye how they change: Their cheeks are paper. – Why, what read you there that have so cowarded and chased your blood out of appearance? King Henry, Act 2, Scene 2, Lines 68-73. This told me that Henry wanted to basically make the traitors convict themselves. Henry then makes a speech about how he cannot give mercy to three people who were so quick to decide upon execution for a man who had only spoken out of tone whilst drunk. This made me think that Henry is firm but fair. He did not convict them straight away and send them to be executed. Instead he let them convict themselves and decide their own punishment, which was death. Henry says that he does not seek revenge for himself but for his country. This tells me that he is a good king who thinks for his country and not just for himself. Many more of Henry actions during the play tell us that he is cool under pressure, thinks for his country. When the Dauphin brings the casket of tennis balls to England, Henry does not lash out and explode into a frenzy of anger, the same as when the baggage boys are killed at Agincourt. He combines his aggression with careful thinking and uses his anger in other places where it is needed. HENRY IS â€Å"THE MIRROR OF ALL CHRISTIAN KINGS,† HOW DOES SHAKESPEARE BUILD UP HIS CHARACTER TO SUGGEST THIS AND WHY? Henry’s words also tell us a lot about him. At the end of the play when he woos his bride to be Catherine, he is very romantic and tries to take her mind off the fact that he is a king and make her realise that he is just an ordinary person. This fact is very important to build up this character of Henry, we have to realise that he is just a normal person and I think that Henry’s words throughout the play often suggest this. At the beginning of the battle of Agincourt, Henry makes a speech, which is now probably one of Shakespeare’s most famous speeches, the St Crispins Day speech. It is used to motivate team spirit in all kinds of sports. Henry uses it to motivate his soldiers, ready for the battle of Agincourt. â€Å"We few, we happy few, we band of brothers.† King Henry, Act 4, Scene 3 Line 60. This line shows us that he has brought himself down from his royal post and is now a brother of all the soldiers who will be fighting with him. Not as their leader, but as a friend, a brother. His speech is enough to make any reader feel patriotic, as it did me and shows that he is a good king, who does not always think of himself as a king. From the methyl benzoate, methyl m-nitrobenzoate will be formed and will undergo purification by re-crystallizing with methanol. Thin Layer Chromatography profile and melting point of the product were used in the experiment to make sure that there are no by-products formed like compounds with o- and p- orientation (2). MATERIALS AND METHODS The mass of conical flask was determined and added with 20 drops of methyl benzoate. The mass was also determined as well as the mass of methyl benzoate itself. The methyl benzoate in the flask was placed in an ice bath while added by 2 ml of conc. H2SO4 while swirling. Then, the nitrating agent was prepared which is a mixture of 1 ml conc. Then, the product was washed with cold distilled water, followed by 5% NaHCO3 and with col d distilled water until the filtrate became neutral. The product was transferred in a watch glass and dried over a steam bath. Methanol was used to recrystallize or solidify the product and the percentage yield was calculated. The melting point of the recrystallized product was determined using the melting point apparatus. The TLC profile was determined using a TLC plate. The TLC plate was drawn with a line using a pencil 1 cm from the bottom and from the top then dipped in a beaker with ethyl acetate. The plate was dipped in ethyl acetate 3 times. When the solvent reached the other edge (the other line), the plate was removed from the beaker. Lastly, Iodine pellets were used to further determine the TLC profile. RESULTS AND DISCUSSIONS Methyl benzoate, C6H8O2, is an aromatic hydrocarbon, a methyl ester with a colorless appearance and used in perfumery. With Methyl benzoate, methyl m-nitrobenzoate will be synthesized and will further be purified by re-crystallization (2) with results shown in Table 1. Table 1. H2SO4. The solution will still be colorless because methyl benzoate is soluble in H2SO4. Thus, it will form a homogenous mixture. On the contrary, it will form a yellow solution if the flask used is contaminated. The nitrating agent prepared in an ice bath because nitration is an exothermic that requires only 15 °C and must not increase (1). HNO3 and H2SO4 should be added in the homogenous solution slowly while stirring to avoid side products formation like compounds with o- and p- orientation. Also, it will result to a low yield of the product desired. Likewise, fast addition will result to getting a high temperature that must be 15 °C only. Addition of H2SO4 if cloudiness will occur is important since methyl benzoate is soluble in sulfuric acid and will produce a colorless solution. The mixture of HNO3 and H2SO4 produces nitronium ion that will attach to the benzene ring (5). Methyl Benzoate is characterized for being electron rich and thus capable of reacting to electrophiles and undergoes EAS or Electrophilic Aromatic Substitution with a mechanism via carbocation [C+] intermediate shown in Figure 1. Figure 1. Complete Mechanism of Nitration via Carbocation Intermediate It follows 3 steps that started from the generation of electrophile which is the nitronium ion, NO2. Then, the formation of carbocation intermediate where nitronium ion will be attacked by the nucleophile will follow. The carbocation in the second step is capable of resonating since aromatic compounds are resonance structure wherein the electron pair can move around the molecule. The resonance of the benzene ring makes them stable and favorable to the reaction since the more stabilize the benzene ring is, the more reaction. The last step is the dissociation of H+ and the reformation of aromatic ring where the electrophile will substitute in one of the hydrogens on the benzene ring. This mechanism resulted to an overall reaction shown in Figure 2. Figure 1. Nitration of methyl benzoate The solvent of the nitration which is the sulfuric acid will protonate the reagent, methyl benzoate, which will create stabilized carbocation intermediate. The electrophile or the electron poor nitronium ion, will react to the protonated intermediate in the meta position. The carboxyl group belongs to the e- withdrawing group that deactivates the aromatic ring. Since electron withdrawing group has a meta orientation and a deactivator, the reaction will take place in the meta position. Likewise, the ortho and para positions are destabilized (5). The major product now is the methyl m-nitrobenzene which has nitro and carboxyl group being both electron withdrawing groups oriented at the meta position. After adding the nitrating agent, the reaction mixture was added 10 g of crushed ice until it solidified and filtrated by vacuum filtration to get a dryer product. It was then washed by cold distilled water and 5% NaHCO to make excess acid neutralize that made the product green-colored. The product was dried over a steam bath and re-crystallized with methanol for purification. By washing the product with methanol, by-products or impurities like substitution on different places on the aromatic ring (ortho and para positions), methyl-2-nitrobenzoate or maybe methy-3-nitrobenzoate formed during the previous reactions should purified to get the preferred product. However, the methanol is preferred cold to control loss of desired product. The re-crystallized methyl m-nitrobenzoate weighed 0.257 and had †¦Ã¢â‚¬ ¦ % yield. The melting point of the re-crystallized methyl m-nitrobenzoate was determined to be 74 °C that is close to its true melting point being 78 °C. The % difference was determined to be 5.13% as shown in Table 2. Table 2. Each trial as the TLC plate was dipped in the solvent (Ethyl acetate) should have only 1 spot that is equivalent to 1 compound. If 3 spots were formed in the TLC plate on 3 trials when the solvent moves on the top of the plate by capillary action, it simply means that 3 compounds were present in the product. Thus, making it considered as not pure. The spots will be clealy visualized when the plate is placed in an iodine vapor (4) here it sublimes from solid to liquid stain. Also, other compounds are capable of adsorbing iodine and become visible. On the contrary, the re-crystallized m-nitrobenzene formed had been considered as a pure compound as illustrated in Figure 3 and had an Rf value of 0.79. Robyn Hode Old English folklore dates back to the beginning of American literature. A protagonist among many, Robin Hood (Robyn Hode in Old English manuscript) is introduced into many books and playwrights. Some may argue that Robin Hood's strategies for balancing society were unethical, but this theory could be strongly argued against, and furthermore disproven. Robin Hood could be considered a hero because of his excessive generosity, his ability to see every person as an equal individual, and his overall success to better society. To accurately view Robin Hoods motives, one must look past the rules and laws set aside for the lower class made by â€Å"higher officials†, and understand that, even more so in a less developed time period, that right and wrong does not depend on what the rich and powerful say is right and wrong. Robin Hood looked past all of this, identified the true, moral decisions that needed to be made, and took charge. By doing so, and taking a small portion of the rich's wealth and distributing it among the poor, is considered (arguably) one of the most notable heroes of the folklore literary era. In all of the tales written of the infamous Robin Hood, the characteristics illuminated most is his excessive generosity. â€Å"Despite being declared an outlaw, Robin Hood is a good and generous person at heart, and is beloved by the townspeople for his deeds.† (Jurns) While thieving and causing (occasional) mishap, Robyn Hode kept one motive in mind, and that was to take from the undeserving, (fat and rich), and give to the needy, (the poor). This obviously biased by assuming that all the rich are greedy and all the poor are hopeless and deserving. In fact, in most cases people work hard fo... ...orth a sort of balance in society, one in which that needed to be presented. Because all the unfortunate people were too afraid to demand this equality in society, Robin Hood's bravery to go in and fight for what he stood for was admired among the people. This is how he was presented the hero title, and why ballads and playwrights are told about him to this day. Robin Hood's strategy to better the society became a success. By stealing from the rich, to give to the poor, he not only set an example for people to follow his role as a hero, but it also created a balance within the social classes. But today, taxes are distributed among the the country that are arguably fair. In Robin's time, the wealthy placed harsh and unfair taxes among the people, many of them who could not afford to pay them. Failure to pay these taxes resulted in imprisonment, or even worse, death.

Prisoners Abuse in Guantanamo Bay Essay

Research indicates that the prisoners at the Guantanamo bay are usually subjected to torture by the prison administrators and guards at the bay. This torture is reported to come up as a result of the torture policy in the United States has led to many inmates at the Guantanamo Bay being treated badly by the prison administrators and guards, who always term them as animals, since they have no one in the legislative to represent them during their trials as they do not have enough knowledge on the judicial systems of their country. In the cases where the offenders are women who are in prison, they happen to undergo a tougher physical and sexual abuse than if the offenders are said to be men. The women normally suffer from mental illness due to the recurring physical or sexual abuse. Apart from the above problem the women also suffer from eating disorders resulting to health problems. Discussion A great number of detainees have been recorded to have been tortured willingly by the united states forces at the Guantanamo Bay while others are jailed with no reason this inmates are found to be mistreated in a manner that can not be avoided this torture usually include; sexual humiliation, threats put on the inmates with dogs these among others are filed as a mode of interrogation in the united states an example of this is in the case where the military guards at the Bay were reported to have tortured the Iraqi inmates whereby, we find that the prisoners were tortured as from being threatened with dogs, being striped naked and also they were forced to wear female underpants on their heads, it was believed that this techniques were authorized by the senior states officials. (Bill 2004) We also find that, President Bush’s administration has advocated for the use of electric shock devices to torture the prisoners at Guantanamo Bay this is well explained in a situation where we find that the state has been exporting devices such as the stun buttons, stun guns among others being exported to other countries such as Cuba, Haiti, India, Turkey and Lebanon. In this case we find that many companies dealing with the production of such weapons have been shipping these products without a license from the government. Through this, there has been an increase in the cases of torturing prisoners in other countries apart from the United States of America. A case of Zahide Durgun who was tortured by the Turkish police in Hakkari where she was tortured with electric shocks to her ear and was later beaten this happened as a result of the police wanting her to accept that she was a member of the political party opposing the government of Turkey. This is well presented in the case released by the FBI report claiming that he had ordered the State to have an inhumane interrogation system against the Iraqis’ detainees; these methods included the sleep deprivation, stress positions and the use of military dogs it is therefore propounded that the Defense department had adopted systems which were illegal and immoral in this instances we find that the CIA had many times refused to contradict the existence of many record of torture in America since it had been confirmed to be involved in the torturing of especially the prisoners in Iraq and in many other CIA facilities for detention globally. The federal has been engaging in torturing its detainees in a manner that provokes their country of originality the best example for this is the situation where interrogation was being conducted by an official in the department of defense where the prisoner was wrapped in an Israel flag whereby the detainee was later shelled with loud mus ic and strobe light. (Johnston, 2006) In the year 2002, the White House was opposed by the Collin Powell who was then the Secretary of the State who had cautioned about the United States breaching the Geneva Convention but the federal went ahead claiming that, the countries inmates were not protected by the Geneva Conventions since some of the detainees were those from Afghanistan who were termed as unlawful enemies, this therefore attracted the attention of most lawyers in the country who came up with legal guidelines for the unlawful act, this action made the military lawyers informed that the breaching of the Geneva convention will lead to the exposure of the states soldiers who were captured to the same torture, after which theses military lawyers took a step forward to see the international human rights lawyer Scott Horton asking the lawyer to give them a stipulated effort in the creation of an environment that has legal ambiguity and also one that shows how the Geneva Conventions was to apply to detainees in the Ba y. (Scranton and Paula 1991) The Effects of the Torture Policy on the Prisoners at the Guantanamo Bay The main policy implication that makes the criminals to be hard cores is always the length of time that the criminals spend in the jails. When they are released for example and directed to attend rehabilitation programs they feel to be wasted because they think that by serving in jail for a long period they are isolated in the society and others may get involved in revenging activities which may cause them more danger of being punished. Under longer prison sentences at the Guantanamo Bay the offender has nothing that will guarantee him protection against the offence he commits which sometimes ends up wasting all his life in jail. Due to the limited informational, educational sources in the prisons, the offender finds it hard to accept change in his mode of life and the behavior that he is addicted in him/her. This means that there are no correction measures which makes the person to become devastated psychologically thus feeling uneasy and may seek to live where he need to help himself escape such a feeling of loneliness and lack of social support through which he may decide to pay any price and sacrifice self-esteem thus forfeiting his life. (Eysenck and Hans, 1996) In some cases the offenders at the prison who are under solitary confinement, are reported to be suffering from disruption of a normal mental function that is normally caused by threats, lack of sleep, starvation and fear of death. Though the incarceration form was meant to encourage a person to confront his own consciousness, it has only led to the offenders at the Bay being stressed because they are under jail conditions that are always cruel and not effective. The conditions in prisons are not normally conducive for an offender such as the coldness of the cells, the food given to the prisoners is always bad and lack of human decency plus noise normally causes resistance to the prisoners for rehabilitation programs. Recommendations As a recommendation for the reduction of the prisoners’ torture at the bay we find that the US federal is urged to come up with laws that enable the treatment of criminals without harsh conditionality. Although, the offenders are entitled to particular constitutional laws, they have various rights in their lives including; the right to be tried by the jury, to be cross-examined and the right to an immediate trial. Since the society has developed a growing concern over the criminal behavior which is ever increasing, the justice system is urged to provide a delinquent preventive measure that will be aimed at preventing the members of the society from indulging in criminal activities. Due to growing concerns over the increased number of criminals, countries have formulated laws that ensure that the criminals especially those detained at the Guantanamo bay involved in criminal cases are restored back to being good people in the society and they have identified rehabilitation policies or program as the best way to nature them instead of putting them under torture like what is happening the Guantanamo bay. Rehabilitation is widely believed by many to be the principal reason of reducing crime. (Committee on Law and Justice, 2004) Rehabilitation normally involves the teaching and training the persons who are addicted to a particular behavior to stop the defective behavior and try to become acceptable members of the society. Therefore under this, the society is given the responsibility of assisting these addicts or criminals by helping them to get hope through various programs that they will be educated thus helping them to heal their bodies and mind. The strengths associated with rehabilitation policies are that the addict will achieve through these Programs education which allows the offender an opportunity to re-enter into the society as a responsible and productive citizen. For example, the people who undergo rehabilitation programs are normally allowed to receive counselling and guidance. For example a rehabilitation program may involve the offenders at the Guantanamo bay in doing community work, such as cleaning the environment and activities that they think suits to the foundation of their interests. This will make them appreciate who they are and accept their presence and roles in the particular society. (Kleinman, 2000) The strength for rehabilitating criminals is that there is always a collective supervision that will be able to provide an environment favourable enough to meet the special needs of the offenders which will help them to join the society newly as responsible and respected persons. However, rehabilitation is prone to some weaknesses which hinder the process of trying to help the offenders to be good and reliable people in the society. For example, the criminals or offenders subjected to rehabilitation programs at the Guantanamo bay feel isolated in the society and thus will not corporate during the entire process. They view themselves as rejected people in the society who are treated maliciously. These aspects make them to feel unworthy in the society and hence after the rehabilitation programs they don’t change but instead continue with bad behavior that they used to engage themselves in. Also another weakness is lack of government support in supporting rehabilitation programs, for example laxity in funding the programs thus few drug addicts and criminal offenders are subjected to such programs. This has resulted to seeking donors who can fund the programs, an activity which is difficult because it’s very hard to find willing donors. (Eysenck and Hans, 1996) Conclusion Torture in the Guantanamo bay prisons is a major problem for many in America and other nations, but the war on Iraq and Afghanistan and the whole issue of terrorism has been stressing the Americans because of the harsh policies imposed by the Bush administration on torture. In general we can therefore deduce that President Bush has not performed his responsibilities and the duties of the president in the maintaining the rights of the detainees in the required way. America is not better of since Bush took over power therefore the next president has a lot of work ahead in rebuilding and restructuring the country’s’ prison administration, for this reasons the federal is given an opportunity to amend and address the effects caused by the torture policy in Guantanamo bay. Bridging the information gap: Aside from managing risk, CFOs could spend considerable time with both the audit and compensation committees to bridge the potential knowledge gap on compensation and financial performance.One example is how to best treat unusual or non-recurring items when calculating incentives. The audit committee is likely to have an in-depth understanding of these items, whereas the compensation committee more fully understands the impact such adjustments may have on incentive plans. The CFO can help link the two committees in helping decide which adjustments, if any, should be made for incentive plan purposes.
